een gebied voor zeehonden aan te geven wordt niet alleen gekeken naar aantallen
die in een gebied worden aangetroffen en naar het aantal jongen dat in een
gebied wordt geboren, maar indien relevant ook naar de betekenis die een gebied
voor zeehonden kan hebben (bv. rustplek om te verharen) in een bepaald deel van
de Waddenzee. <o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><B
style="mso-bidi-font-weight: normal"><I
style="mso-bidi-font-style: normal"><SPAN

een gebied als hoogwatervluchtplaats voor vogels aan te geven wordt gerefereerd
aan de internationale populatie. In de SOVON-rapportage worden de soorten
genoemd waarvan over de afgelopen vijf jaren een gemiddeld seizoensmaximum van
minimaal 0,1 % van de internationale populatie in het betreffend gebied is
geteld. In deze uiteenzetting nemen we dit niet helemaal over maar noemen we
alleen die soorten waarvan in een gebied meer dan 0,3 % is geteld (“van groot
belang”). Een gebied noemen we voor een soort van zeer groot belang als meer dan
1 % van de internationale populatie is geteld. <o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Van de broedvogels
wordt aangegeven welk deel van de Nederlandse Waddenpopulatie in een bepaald

het ecologisch belang van de gebieden is al eerder meegestuurd aan de
Klankbordorganisaties bij het concept wijzigingsbesluit zoals toegezonden op 29
september jl., samen met de rapporten met ecologische informatie van IMARES en
SOVON.<o:p></o:p></SPAN></P>

wijzigingsvoorstel van LNV, besproken in de Klankbordgroep vergadering op
26-08-09, heeft LNV diverse bezwaren en opmerkingen ontvangen. Ook op het
concept-besluit, conform de Leidraad voor zienswijze toegestuurd aan de
Toeristische Organisaties Waddenzee op 29 september jl., heeft LNV enkele
zienswijzen en bezwaren ontvangen. Per gebied wordt aangegeven hoe de ontvangen
reacties en de daarin beschreven belangen zijn gewogen.<o:p></o:p></SPAN></P>

gebiedssluiting toe na een afweging van het belang van een gebied voor
beschermde natuurwaarden, en de kans op en de gevoeligheid voor verstoring.

afweging wil LNV het komend seizoen werken met de mogelijkheid van voordracht
van gebieden door zowel de klankbordgroep als de terreinbeheerders op basis van
monitoringinformatie, eventueel aangevuld met eigen informatie, voor opname in
of afvoeren van de lijst van rustgebieden in de Waddenzee, indien er nog
onvoldoende zekerheid bestaat over de kwalificatie van betreffend gebied voor
openstelling dan wel sluiting. Is die zekerheid er wel, dan kan direct de in de
Leidraad beschreven procedure voor openstelling dan wel sluiting worden gevolgd.

Simonszand is aangewezen ter bescherming van zeehonden. Het is gesloten van 15/5
tot 1/9. Het Simonszand bestaat uit twee samenhangende platen (Simonsrif en
Simonsplaat) die afhankelijk van de waterstand te onderscheiden zijn of één
geheel vormen.<o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt"><o:p> </o:p></SPAN></P>

Lauwersoog. De toegangsbeperking heeft betrekking op het gebied aangegeven in

zeer groot belang als hoogwatervluchtplaats (HVP) voor o.a. Zilverplevier, Wulp,
Kanoet (gemiddeld seizoensmaximum 1,2 % van de internationale populatie), Bonte
strandloper (1,4 % van de internationale populatie), en Drieteenstrandloper (1,6
% van de internationale populatie).<o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">De afgelopen jaren is
het Simonszand door natuurlijke dynamiek lager komen te liggen. Het
droogblijvend oppervlak bij vloed neemt hierdoor af. Juist hierdoor neemt de
betekenis van het gebied als HVP nog toe.<o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Het gebied wordt
bovendien regelmatig verstoord door recreanten. Daarom is sluiting van het
gebied om de kwetsbare natuurwaarden te beschermen
wenselijk.<o:p></o:p></SPAN></P>

wadlooporganisaties is aangegeven dat Simonszand een belangrijke plaat is
waarnaar en waarvandaan wadlooptochten worden georganiseerd.

Watersportverbond is aangegeven dat met name voor zeekanoërs, droogvallers en
wadlopers dit een belangrijk gebied is.<SPAN style="mso-spacerun: yes">

is aangegeven dat Simonszand een van de laatste plekken is waar vissers uit
Lauwersoog en Noordpolderzijl terecht kunnen.<o:p></o:p></SPAN></P>

LNV<o:p></o:p></SPAN></I></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Uit vogeltellingen
blijkt dat het Simonszand van grote internationale betekenis is als HVP.
<o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Ook worden bezoeken
aan en bij het gebied jaarlijks gemonitord zodat er een goed beeld is van
betreding en verstoring. Waarnemingen van de Vogelwacht Rottumerplaat over de
afgelopen vier jaren laten zien dat in de huidige situatie het oostelijk deel
van Simonszand regelmatig wordt bezocht door wadlopers en kanovaarders en er
regelmatig wordt drooggevallen. <o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Regelmatig
constateert de vogelwacht dat betreding voor (grote) verstoring van vogels en
soms ook zeehonden zorgt.<o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Kanoërs: jaarlijks
bezoekt een aantal kanoërs het gebied, meestal met overnachting in tenten
(waarnemingen vogelwacht 2006: 76, 2007: 8, 2008: 43, 2009: 23). Wadlopers: de
afgelopen vier jaar constateerde de vogelwacht jaarlijks diverse wadlooptochten
naar Simonszand. Wadlopers komen aan tijdens laag tij en worden over het
algemeen uiterlijk rond drie uren voor hoogwater weer opgehaald. Een enkele maal
blijven ook enkele wadlopers een tij over of overnachten.<o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Droogvallers: de
vogelwacht telde de afgelopen 4 jaar tussen de 13 en 47 droogvallende schepen
per jaar bij Simonszand. Met name wordt vanaf droogvallende schepen veel
gewandeld, ook met (loslopende) honden. Schepen liggen regelmatig een hele dag
of overnachten, zijn dus ook hele eb en vloed cycli
aanwezig.<o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">LNV concludeert dat
de regelmatig voorkomende aanwezigheid bij / op Simonszand de HVP-functie
verstoort. Om verstoring van de aanwezige natuurwaarden te voorkomen is sluiting
gedurende de hoogwaterperiode nodig. Dit betekent dat betreding van de plaat
binnen de gesloten periode niet mogelijk is. Ankeren en droogvallen buiten de
artikel 20-begrenzing, en/of buiten de gesloten periode blijft wel
mogelijk.<o:p></o:p></SPAN></P>

style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Wadlopers: Na overleg
met het Wadloopcentrum Pieterburen is geconstateerd dat de georganiseerde
wadlooptochten kunnen blijven plaatsvinden omdat de aangegeven begrenzing van de
HVP hiervoor voldoende ruimte laat aan de zuidoosthoek. Het is
verantwoordelijkheid van de wadlooporganisaties om er op toe te zien dat de
wadlopers niet binnen de gesloten periode het gesloten gedeelte van de plaat
oplopen. <o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">Visserij: het te
sluiten HVP-gebied betreft geen mogelijke visgronden.<o:p></o:p></SPAN></P>

dynamisch gebied. Van nature kan de ligging van platen en geulen aanzienlijk
verschuiven door de natuurlijke dynamiek. <o:p></o:p></SPAN></P>

Jaarlijks houden zich in dit gebied meer dan honderd zeehonden op. Voor de
zeehond is dit ook een belangrijk geboortegebied. Verspreid in het zuidwestelijk
gebied worden beduidend meer jonge zeehonden geboren dan in het noordelijke
gebied, jaarlijks 20 tot 25. Het verschilt enigszins per jaar waar de dieren in
dit gebied liggen. Dit is afhankelijk van de natuurlijke dynamiek. Hoofdzakelijk
zijn de zeehonden te vinden langs of in de buurt van de geul die vanuit het
Oosterom richting de Kromme balg loopt. <o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN

gesloten gebied of het toestaan van doorvaart door de genoemde geul, zoals

het verjagen van dieren uit dit gebied zorgen. Verandering van de

seizoensmaximum 1,7 % van de internationale populatie), Drieteenstrandloper,
Bonte strandloper, Rosse grutto (1 % van de internationale populatie), en
Zilvermeeuwen.<o:p></o:p></SPAN></P>

ongeveer de helft van alle Nederlandse jonge zeehonden geboren.

(3,1 %), Drieteenstrandloper, Bonte strandloper (2,5 %), Rosse grutto, Wulp (1

zodat de geul Sparregat oostelijk van Rottumerplaat, liggend in het gebied
Horsbornzand, toegankelijk wordt buiten de gesloten periode van het

dicht langs Rottumeroog. Verruiming van de toegankelijkheid van deze geulen door

droogliggers aantrekken. Dit zou de functie van Rottumerplaat als HVP onder druk
zetten en is daarom ongewenst.<o:p></o:p></SPAN></P>

Lepelaars (gemiddeld seizoensmaximum 1,5 % van de internationale populatie). Als
broedgebied zijn beide gebieden samen van zeer groot belang voor Lepelaar (6 %
van de Waddenpopulatie), Bruine kiekendief (3 %), Kleine mantelmeeuw (9 %),
Velduil (4 %), en Tapuit (9 %).<o:p></o:p></SPAN></P>

gedeelte in het veld worden gesloten middels hierop gerichte

voorafgaande aanwijzingsbesluit 2006 is voor het Rif vanwege de broed- en
HVP-functie een toegangsbeperking (gehele sluiting) aangegeven van 15 mei tot 1
augustus. <o:p></o:p></SPAN></P>
<P style="MARGIN: 0cm 0cm 0pt" class=MsoNormal><SPAN
style="FONT-FAMILY: 'Arial','sans-serif'; FONT-SIZE: 10pt">In 2008 is besloten
dat ten aanzien van bescherming van broedvogels, het Rif pas gesloten hoeft te
worden als dit op grond van de actuele situatie nodig is. In sommige seizoenen
komt er door stormen en dergelijke van het broeden niet veel terecht. Dan is
sluiting om broedvogels te beschermen ook niet nodig. Dit “maatwerk” kan worden
toegepast door de aanwezigheid van vogelwachters op de Engelsmanplaat. Als die
een broedvogelkolonie waarnemen, wordt alsnog het betreffende deel tijdens de
broedperiode gesloten. Dit blijkt in de praktijk goed te werken.

niet nodig om voor broedvogels terug te gaan naar het strengere

tevens besloten het Rif vanwege de HVP-functie te sluiten van 3 uur voor tot 3
uur na hoogwater. Hierover is tijdens het bezoek van LNV, SBB en Wadvaarders aan
het Rif in mei 2009 afgesproken dat het westelijk deel van het Rif toegankelijk
zou zijn voor droogvallende schepen. Ook zouden op dit westelijk deel
afzonderlijk vogeltellingen worden uitgevoerd om de functie van HVP apart voor
het westelijke deel te kunnen monitoren. Tenslotte zou LNV wijziging van de
toegankelijkheid van dit gebied aan de Wadvaarders doorgeven indien dit nodig
zou zijn vanwege aanwezigheid van een HVP of van
broedvogels.<o:p></o:p></SPAN></P>

voor het komende seizoen dezelfde werkwijze te volgen voor het westelijke deel
van het Rif. Dit betekent dat op de hydrografische kaart de contour van het
artikel 20-gebied gehandhaafd blijft, maar dat het westelijke deel van het Rif
toegankelijk is voor droogvallende schepen. De grens van dit deel zal in het
veld worden gemarkeerd. Dit westelijk deel zal opnieuw apart door de
vogelwachters worden gemonitord. Als zij de aanwezigheid van een HVP of van
broedvogels waarnemen, zal alsnog de toegang tot dit westelijke deel worden
beperkt. LNV zal hiervan tijdig melding maken.<o:p></o:p></SPAN></P>

gaven aan dat het onverstandig is om de gesloten periode te verminderen en
adviseren om voor alle HVP’s een sluitingsperiode aan te houden van 3 uur voor
tot 3 uur na hoogwater. Het verslag van de expertbijeenkomst is aan de
Klankbordorganisaties toegezonden op 29-09 jl.<o:p></o:p></SPAN></P>
